Between SOFT KIDS S.A.S, 231 Rue SAINT HONORE, 75001 Paris, with a share capital of €30,000, registered in the Nanterre Trade and Companies Register under number 850 938 184, SIRET 85093818400015, represented by Human & Skills in its capacity as President, duly authorized for the purposes hereof.

On the one hand, and the individual or legal entity purchasing products or services from the company, hereinafter referred to as "the Buyer" or "the Customer" On the other hand, the following has been set forth and agreed.

The Vendor is a publisher of educational digital products and services exclusively for consumers, marketed through its website(https://www.softkids.net/) and its SOFT KIDS application.

Digital kits

About our digital download kits

  • These are digital products : no paper version will be sent by post.
  • After purchase, the PDF file is automatically downloaded and available in your "Downloads" area.
  • A download link is also sent by e-mail in the order confirmation.

Each purchase includes :

  • A French version in A4 format (A4 format, depending on kit)

🔒 No refunds can be made once the kit has been downloaded.

User license

Each purchase entitles you to :

  • Personal, non-commercial use for a family, or for a teacher with a class of 1 to 35 pupils.

It is prohibited to :

  • Sharing PDF files with third parties
  • Distribute it free of charge or for a fee
  • Modify or sell it, even partially

Applications

Article 1: Purpose and general provisions

The present General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products offered by the Seller.

These General Terms and Conditions of Sale (GTCS) apply to all sales of Products made through the Company's website and its application, which form an integral part of the Contract between the Buyer and the Seller. The Vendor reserves the right to modify these terms and conditions at any time by publishing a new version on its website. The terms and conditions then applicable are those in force on the date of payment (or of the first payment in the case of multiple payments) of the order.

These GCS can be consulted on the Company's website at https://www.softkids.net/.

The Company also ensures that their acceptance is clear and unreserved by setting up a checkbox and a validation click. The Customer declares that he/she has read the present General Terms and Conditions of Sale, and any Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation. The Customer acknowledges that he/she has received the necessary advice and information to ensure that the offer meets his/her needs. The Customer declares that he/she is legally capable of entering into a contract under French law, or that he/she validly represents the individual or legal entity on whose behalf he/she is entering into a contract. In the absence of proof to the contrary, the information recorded by the Company constitutes proof of all transactions. The Customer declares to be of legal age and fully capable of contracting.

Article 2: Prices

The prices of products sold through the website and the application are indicated in Euros, exclusive of tax, and are precisely determined on the product description pages. The Company reserves the right to modify its prices at any time in the future. Telecommunication charges for access to the Company's websites are at the Customer's expense. Prices displayed on the site may be modified at any time without prior notice. These modifications will not affect Products already purchased by customers and confirmed by the Site.

Initial subscription duration and renewal 

The duration of the subscription is specified for each of our offers. Once access to the content has been opened under the above conditions, it is at the customer's sole discretion. The customer's choice not to use his subscription or to use only part of the content attached to his subscription can never justify any reduction in price or reimbursement of the subscription.

The initial contract is concluded for the duration of the subscription chosen by the customer. It will then be tacitly renewed for the same period as the initial subscription. Subscriptions can be cancelled at any time via your Apple ID settings. In this case, you must cancel at least 24 hours before the end of the current payment period. The current non-renewed subscription will then terminate at the end of the current payment period.

Renewal is subject to the price conditions applicable to subscriptions of the same duration and in force on the effective date of renewal.

At the time of each renewal, the customer must inform us of any changes to his or her data, as stated for the record in the letter informing of the rejection of tacit renewal.

He/she undertakes to keep his/her data up to date: in particular the data required for identification, correspondence and payment of subscriptions.

Subscription prices in euros including VAT at February 22, 2025:

12 months: 79€99

1 month: 9€99

Article 3: Online contracting

The steps described below are systematic for the conclusion of the contract, whether for products offered or purchased:

  • Information on the essential characteristics of the product ;
  • Choice of product and, if applicable, its options and indication of essential customer data (identification, postal code, e-mail, etc.);
  • Acceptance of these Terms and Conditions.
  • The Customer will then receive confirmation by e-mail of his registration to benefit from the products.
  • Follow-up of payment instructions, and payment of products.
  • The Vendor reserves the right to refuse an order, for example for any abnormal request, made in bad faith or for any legitimate reason.

Article 4: Products and services

The essential characteristics of the goods, services and their respective prices are made available to the purchaser on the company's website. The customer confirms that he has received a detailed description of the terms of payment and contract execution. This contractual information is presented in detail and in French. In accordance with French law, they are summarized and confirmed when the order is validated. Except in the case of special conditions, the rights granted hereunder are solely those of the natural person signing the order (or the holder of the e-mail address communicated).

Article 5: Retention of title

Products remain the property of the Company until full payment has been received.

Article 6: Payment

Payment is due immediately upon order, including for pre-ordered products. For our applications on cell phones or tablets under IOS, the payment method offered is Apple iTunes. For Android cell phones or tablets, the payment method offered is Google Play Store Pay. The customer can pay by credit card for products on the website. Secure online payment by credit card is carried out by our payment service provider. The information transmitted is encrypted and cannot be read during transport on the network, first on our website and then on our payment solution.

Once payment has been initiated by the Customer, the transaction is immediately debited once the information has been verified. In accordance with article L. 132-2 of the French Monetary and Financial Code, the commitment to pay by card is irrevocable. By providing his/her bank details at the time of sale, the Customer authorizes the Vendor to debit his/her card for the amount relating to the price indicated. The Customer confirms that he/she is the legal holder of the card to be debited and that he/she is legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the Sale is immediately cancelled and the order cancelled.

Article 7: Withdrawal period

In accordance with article L. 121-20 of the French Consumer Code, "the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods". "The period mentioned in the previous paragraph runs from receipt for goods or acceptance of the offer for services. The right of withdrawal may be exercised by contacting the Company as follows:

The customer sends an e-mail to contact@softkids.net, indicating the name of the program he/she wishes to be reimbursed for, and the seller then re-credits the credit card. If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) purchased will be refunded. In accordance with legal provisions, you will find below the standard retraction form to be sent to us at the following address: contact@softkids.net.

Refund procedure: the customer is directly credited with the amount of the program they wish to be refunded within 14 days.

Article 8: Warranties

In accordance with the law, the Vendor assumes two warranties: of conformity and of hidden defects. The Vendor will reimburse the purchaser or exchange products that appear to be defective or do not correspond to the order placed. The Vendor reminds you that the consumer: - has a period of 2 years from delivery of the goods to take action against the Vendor - that the consumer may also invoke the warranty against latent defects in the goods sold under article 1641 of the French Civil Code and, in this case, may choose between rescission of the sale or a reduction in the purchase price (provisions of articles 1644 of the French Civil Code).

Article 10: Intellectual property rights

Certain processing activities by SOFT KIDS may depend on your consent. In this respect, you are entitled to withdraw your consent at any time. The withdrawal of your consent will not affect the legitimacy of the processing carried out prior to your withdrawal. If you withdraw your consent, SOFT KIDS and third parties involved in the processing of personal data will cease to process your personal data, except and to the extent that continued processing or storage is permitted or required in accordance with applicable personal data legislation or other applicable laws and regulations. Please note that following the withdrawal of your consent, SOFT KIDS may not be able to respond to your requests or provide you with its services.

Article 11: Force majeure

The performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent such performance. The seller will notify the customer of the occurrence of such an event as soon as possible.

Article 12: Invalidity and amendment of the contract

Should any of the stipulations of the present contract be null and void, this shall not invalidate the other stipulations, which shall remain in force between the parties. Any contractual modification is only valid after a written and signed agreement between the parties.

Article 13: Protection of personal data

In accordance with the French Data Protection Act (Loi Informatique et Libertés) of January 6, 1978, you have the right to query, access, modify, oppose and rectify your personal data. By accepting these general terms and conditions of sale, you consent to the collection and use of your personal data for the purposes of this contract. By entering your email address on our website and our application, you will receive emails containing information and promotional offers concerning products published by the Company and its partners. You can unsubscribe at any time. To do so, simply click on the link at the end of our emails. We monitor traffic on all our sites. To do this, we use tools such as Google analytics.

Article 14: Applicable law

All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to herein, shall be governed by French law.
